1. INTRODUCTION

Global Orphan Pharmaceutical, LLC (GOP) reserve the rights, at our discretion, to modify, add, or remove portions of these terms and conditions to be effective immediately upon posting. Please check these terms and conditions periodically for changes. The posting of changes to these terms and conditions shall mean you accept those changes. This Site is intended for adults at least 18 years of age or older. By using this Site, you acknowledge that you are 18 years or older. Due to the nature of the internet, GOP cannot prohibit minors from visiting our Site. However, all purchases of goods or services on our Site must be made by adults 18 years of age or older, and all users who register with our Site must be 18 years of age or older or provide parental consent. Global Orphan Pharmaceutical, LLC is not responsible for the consequences of any communications in the Public Areas. You shall have the opportunity through our "Facts" or “Community Wellness” feature on certain areas of our Site to e-mail us with questions you may have for our featured expert regarding our products, dietary supplements in general or health matters in general. 4. INDEMNIFICATION AND HOLD HARMLESS

 

A. INDEMNIFICATION BY USER

USER AGREES TO INDEMNIFY, DEFEND AND HOLD GOP HARMLESS FROM ANY LIABILITY, LOSS, CLAIM AND EXPENSE, INCLUDING ATTORNEY'S FEES RELATED TO A USER'S VIOLATION OF THESE TERMS AND CONDITIONS OR THE USE OF THE SERVICES AND INFORMATION PROVIDED AT THIS SITE.

You agree to indemnify, defend and hold GOP and its affiliates and their respective officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") harmless from and against any and all claims, demands, liabilities, costs and/or expenses whatsoever (including without limitation reasonable legal fees and disbursements) arising out of or resulting, directly or indirectly, from: (a) your breach of these Terms and Conditions; (b) your access to or use of this Site or any website to which this Site is or may be linked from time to time; (c) your use of, reliance on, or publication, communication or distribution of anything on or from this Site; and/or (d) your violation of any law, rule or regulation. In any event, you shall not settle any claim, lawsuit or action subject to indemnification by you without the prior written consent of GOP.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO, NEGLIGENCE, SHALL GLOBAL ORPHAN PHARMACEUTICAL, LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENCEES, SUPPLIERS, OR THOSE HEALTHCARE PROFESSIONALS WHO HAVE CONTRIBUTED MATERIAL TO OR ANSWERED QUESTIONS ON THE SITE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNATIVE DAMAGES, PERSONAL INJURY, OR WRONGFUL DEATH WHATSOEVER, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST REVENUE, LOST OR DAMAGED DATA, OR OTHER COMMERCIAL OR ECONOMIC LOSS THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THIS SITE OR THE INFORMATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT, INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN WARRANTY, CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO, NEGLIGENCE, OR OTHERWISE), INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, STRICT LIABILITY OR OTHER LEGAL THEORY) EXCEED TWENTY-FIVE U.S. Dollars ($25.00).

B. QUANTITY LIMITS AND RESALE ITEMS

GOP reserves the right to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. GOP also reserves the right to prohibit sales to dealers.

C. SALES AND DISTRIBUTION

Distributor shall not sell any GOP product on eBay, Amazon, any of their affiliate's websites or any other auction website or online marketplace. Prices do not include and are net of any foreign or domestic governmental taxes or charges of any kind that may be applicable to the sale, licensing, marketing or distribution of the products. Distributor understands and acknowledges that all sales are final and that they are not entitled to return any product for a refund. GOP shall not be responsible for delays or lack of delivery due to customs clearance issues.

D. CANCELLATION POLICY

Once an order has been submitted your credit card shall be charged. GOP’s ordering process is streamlined so your order shall immediately be sent to processing and then shipping. Due to the high volume of orders GOP receive, GOP shall be unable to cancel an order after submitted. Please order carefully.

E. ORDER RETURNS

You may return any unopened product purchased at our store with accompanying receipt within thirty days of purchase and receive a full refund.

I. ENTIRE AGREEMENT

This Agreement constitutes the entire and only Agreement between GOP and each user of this Site with respect to the subject matter of this Agreement and supersedes any and all prior or contemporaneous Agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of this Agreement.
